Disqualifying Trump from holding elected office

Champions of Democracy was founded in August 2023, inspired by the publication of an article in The Atlantic by J. Michael Luttig and Laurence H. Tribe entitled “The Constitution Prohibits Trump From Ever Being President Again.”

Luttig, a former federal judge on the U.S. Court of Appeals for the Fourth Circuit who has been called “perhaps the most conservative judge in the country,” and Tribe, the Carl M. Loeb University Professor of Constitutional Law Emeritus at Harvard Law School, write in the article:

The former president’s efforts to overturn the 2020 presidential election, and the resulting attack on the U.S. Capitol, place him squarely within the ambit of the [Fourteenth Amendment’s] disqualification clause, and he is therefore ineligible to serve as president ever again. The most pressing constitutional question facing our country at this moment, then, is whether we will abide by this clear command of the Fourteenth Amendment’s disqualification clause.

Some argue that we should “let the voters decide” Donald Trump’s political future. However, we believe that his sustained attack on the fundamental values, principles, and institutions at the heart of American democracy demand more than a political response—the institutions of American democracy themselves must reject his assault on the constitutional order.
